General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries made by fention engineering & creation GmbH (hereinafter “fention”) to consumers.

A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither related to their commercial nor their self-employed professional activity.

2. Contracting Party

The purchase contract is concluded with fention engineering & creation GmbH, Kaiserstr. 52, 51643 Gummersbach, Commercial Register: Gummersbach, No. HRB 128396.

3. Conclusion of the Contract

3.1. The presentation of products in the online store does not constitute a legally binding offer, but merely an invitation to place an order.

3.2. By clicking the “Confirm” button, you are placing a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of Withdrawal

4.1. If you are a consumer (i.e., a natural person placing an order for a purpose that cannot be attributed to your commercial or self-employed professional activity), you have a right of withdrawal in accordance with the statutory provisions.

4.2. If you, as a consumer, exercise your right of withdrawal pursuant to Section 4.1, you must bear the standard costs of the return shipment.

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us, fention engineering & creation GmbH, Kaiserstr. 52, 51643 Gummersbach, +49 175 9171148, kontakt@fention.de, of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email). You may use the attached sample withdrawal form for this purpose, though its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we must refund to you all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without delay and, in any case, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you ship the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to inspect their condition, characteristics, and functionality.

5. Prices and Shipping Costs

5.1. The prices listed on the product pages include applicable sales tax and other price components.

5.2. In addition to the listed prices, we charge shipping costs for delivery, which depend on the size of the goods and the destination. The shipping costs will be clearly displayed again on the product pages, in the shopping cart, and on the order page.

6. Delivery

6.1. Delivery is made via the shipping provider selected when placing the order and using the specified shipping method or a higher-tier shipping method.

7. Payment

7.1. Payment is made via the prepayment method selected when placing the order.

8. Retention of Title

8.1. The goods remain our property until full payment has been received.

9. Warranty for Material Defects

9.1. fention is liable for material defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB).

9.2. An additional warranty for goods delivered by fention exists only if it was expressly stated in the order confirmation for the respective item.

10. Dispute Resolution

We are willing to participate in a dispute resolution procedure before a consumer arbitration board to resolve disputes with consumers. The competent consumer arbitration board is:
